Firstly, it should be noted that this man is well known as a liberal judge.
Secondly, he has an interesting point. If we’re going to have a DNA database, restricting it to that set of people who have been picked up by the police in the past gives it a number of unjust biases. One could have a just DNA database in a few other ways (e.g. only convicted criminals); he has picked the simplest.
Still a really nasty idea, though.
